MIN. 3954. DECLARATION OF INTERESTS.= =

Mrs Golding declared a Personal interest in the planning application on Tunnel Road.

MIN. 3955. QUESTION TIME OPEN SESSION. =

The Members of the public present had just come= to listen to the meeting and did not want to discuss any points.

An item on the agenda, that County Cllr. Byram = was interested in, was brought forward.

MIN. 3956. VILLAGE HIGHWAYS AND TRANSPORTATION ISSUES.

County Cllr Byram reported that the school bus operating in Barnton was put on for the catchment area only. Any spare seats can be taken up. The tickets are done termwise as i= t is a cut price compared to daily tickets. The bus company is not prepared to operate weekly tickets. The bus drivers have reported that= they never drive on footpaths, but have been instructed that they must never do it. Sir John Deanes College a= nd Hartford High School are in the catchment for Barnton. If a family is receiving a hardship allowance they have the right of appeal.&n= bsp; As the Parish Council has had no direct complaint they cannot act. Mr Casey has been approached by a = family who felt that £100 a term per child was an excessive amount to pay. In the past they were allowed to p= ay £1 each way but now they have to have a season ticket. There was a County Council investi= gation into school buses approximately six months ago. A proposal was made by Mr Kennish = to write to the County Council to discover the outcome of the investigation. It was seconded by Mrs Ashdown. Al= l in favour.

8.1 UPDATE ON THE PROPOSED NO WAITING ORDER ON LYDYETT LANE.

The Council has only received two complaints ab= out the No Waiting order. On the = survey of residents 26% felt the order would make no difference and 46% felt it wo= uld make things better. No correspondence has been received from Richard Flood. Ms Kirsopp was concerned that the members of the Council who were present at the meeting with the Highways Ag= ency voted on the scheme, however no vote for approval was received from the Par= ish Council. The feeling was that= a mandate to get the best available option was received before they attended = the meeting, and the Council members went as representatives of and with the support of the Parish Council. The Joint Highways Committee has given the approval for the scheme to go to consultation. = &nb= sp; = &nb= sp; = &nb= sp;

County Cllr. Byram left the meeting.=

MIN. 3957. APPROVE MINUTES OF MEETING HELD ON 2= 9th SEPTEMBER 2008.

It was proposed by Mr Hearsey to approve the mi= nutes of 29th September 2008. Seconded by Mr Wills. Seven were in favour, five abstent= ions.

MATTERS ARISING FROM THE MINUTES OF 29th SEPTEM= BER 2008.

MIN. 3958. (FROM MIN. 3949).

Clarification was requested on the last three l= ines of Min. 3949, a rumour campaign about the skate ramps. Abuse has been occurring of the sk= ate ramps, they have been painted with unsuitable paint, had oil poured on them= and burned and graffiti applied. = It was suggested that the skate ramps be removed if further abuse was noticed. The feeling was that the paint had= been applied to the ramps to try to increase the grip. Mr Hearsey said that he felt the r= amps were probably safe if used properly and not abused. A proposal was made by Mr Daniels = to leave the situation as it is at the moment; it was seconded by Mr Hearsey, seven in favour, five abstentions. Mrs Wilson said in her area high profile adults are used to work with the youths to help encourage responsible use of the equipment. Ms Kirsopp requested that some ide= as be brought to the next meeting. = Mr Wills said the youths responded favourably to Council members being seen at= the ramps, suggesting their own ideas for the park. He suggested that a couple of Coun= cil members go to the park each month to be seen.

MIN. 3959.&nbs= p; (FROM MIN. 3935.).

The size limit of trees has been obtained. The largest available are 3 –= ; 5 metres high, 15 – 20 years old, any bigger than that and a low loader would be required for transport and a crane for lifting, resulting in the p= rice becoming limiting. Some of the trees that have been broken have become bush trees. Where the trees have been broken a= nd are growing as bush trees they are to be left and new trees planted elsewhere.<= span style=3D'mso-spacerun:yes'> In the wild garden next to number = 20 Hayes Drive there is a gap which needs filling with trees and shrubs. Mr Wills suggested that the broken= trees be pruned to tidy them up and not give ideas to individuals who may be incl= ined to break others. A suggestion= was made to only plant pollarded trees as they appear to arise no interest.

MIN. 3960. PLANNING APPLICATIONS.

5.1. 08-2089-CAC & 08-2090-FU= M = - Land and Buildings including 7 Tunnel Road, Barnton. Demolition of existing Garages and Workshops and erection of 13 Residential Units (8 Apartments an= d 5 Dwellings)

This Application has been dealt with by the Pla= nning Sub Committee who have recommended that it be refused. The reasons stated for refusal are= ;

1. OVER DEVELOPMENT OF THE SITE. Despite the known National Government Guideline= s for the development of previously used land the Parish Council consider that th= is number of Residential Units at this location in a Conservation Area is unsuitable and inappropriate

2. LACK OF AN ENVIRONMENTAL ASSESSMENT. No Environmental Assessment has been provided by the Developer and of particul= ar concern to the Parish Council is the Badger set further up the Valley close= by the site boundary and the effect that this Development might have on the we= ll being of the Badgers.

3. HIGHWAYS AND TRANSPORT ISSUES. <= o:p>

(i). The Parish Council are of the opinion that the Developers Traffic Impact Assessment is seriously flawed and there will be an actual increase in the amount of Traffic using Tunnel Road. To assume that there will only be 1 vehicle per household is not risible

(ii). The single vehicle width Tunnel Road is n= ot in the opinion of the Parish Council sufficient for the increase in traffic and use that will take place and the actual&nb= sp; junction affording access to and from Runcorn Road off a very danger= ous bend will prove especially hazardous even with a suitable visibility splay provided.

(iii). The Parish Council express serious conce= rn at the insufficient level of off street parking provided for these dwellings a= nd would point out that we have already enough parking problems in our Village without deliberately creating more for us.

Views had to be in by 24th October, a letter wa= s sent to Vale Royal with the objections above and a request that the application = be refused. On November 18th it = goes to the planning committee. Th= ree complaints have been received from residents.

5.2 08-2076-FUM - Land to the South of Hough Lane Farm, Hough Lane, Comberbach.

Change of Use of Land from Agriculture to Horticulture including Alteration to Access, erection of a Potting Shed, 2 = No. Poly Tunnels, portable building and hard standing for Horticultural purpose= s.

This Planning Application has been dealt with b= y the Planning Sub Committee who had no objections.

This is a neighbouring Parish Council applicati= on.

5.3. 08-2186 -COU - 83 Grange Road, Barnton.

Change of Use of existing Building at Rear to T= axi Operating Office (3 No. Vehicles - 1 Vehicle to be parked at the site.=

There has been one written representation from = Number 85 Grange Road. The resident = is disabled and has a shared access to the drive. The applicant has apparently been running the business since September and has six vehicles parked outside the property. The letter has been forwarded to Vale Royal. It w= as proposed by Mr Kennish and seconded by Ms Kirsopp to object to the applicat= ion on the grounds of the shared access and it was felt that the nature of the business was inappropriate for a residential area due to the late nights and noise. Nine were in favour, t= hree abstentions.

5.4. 08-0932-LBC - 38 Runcorn Road, Barnton

CONVERSION OF LOFT SPACE AND R= EPLACE 2 NO. EXISTING VELUX WINDOWS WITH ONE = ; CONSER= VATION TYPE ROOF LIGHT. REPLACE ONE VELUX WINDOW WITH RECLAIMED SLATES.=

Letter from the Planning Officer at Vale Royal = B. C. explaining the reasoning behind the Application following comments by the Parish Council on the Consultation.

Vale Royal B. C. wrote to the Parish Council in response to a letter from the Council sent on 19th May. They state that there is no time l= imit with regards to immunity from enforcement for listed buildings. The roof lights were installed bef= ore the present owners purchased the property.= They are considered to be unacceptable for a listed property, the preference being for roof lights that fit flush with the roof slates. The roof conversion would be consi= dered acceptable only for storage purposes, only justifying one roof light. The applicant has been advised to withdraw the application and submit a more acceptable scheme.

CORRESPONDENCE

MIN. 3961. BARCLAYS BANK ACCOUNTS.

The Precept cheques were refused as the new man= date wasn’t accepted. Mr Hearsey’s signature was refused.&nbs= p; Many lengthy phone calls were required to rectify the problem. Several problems have been had with Barclays Bank, they removed the Clerk from the list of signatories when he = had never been one, then refused to acknowledge him with regards to the account= and sent all correspondence to Ms Kirsopp.&nbs= p; Mr Kennish proposed that a formal complaint be sent to the bank, thi= s was seconded by Ms Kirsopp, all in favour.

MIN. 3962.&nbs= p; AUDIT COMMISSION - ANN= UAL RETURN FOR BARNTON PARISH COUNCIL. A clean bill of health has been received from the external auditors = with the exception of the risk assessment. It was felt that although considered, the document produced does not= constitute a formal risk assessment and should be reviewed. <= /span>

MIN. 3963.&nbs= p; VRBC – POTENTIAL GYPSY AND TRAVELLER SITES.<= /u>

There has been an extension to the consultation period to 5.00pm on 14th November 2008.&nb= sp; The Council Executive will produce a report detailing the response to the consultation at its meeting on 15th January 2009. No-one has asked for support in th= is matter and it does not affect the Parish Council directly. Any response can be made online if desired.

MIN. 3964.&nbs= p; REMEMBRANCE PARADE.

The remembrance parade will go ahead as normal = on Sunday 9th November, meeting at Christchurch at 10.30am. The practice on Friday 7th will co= mmence at 6.30pm at the Parish Church. Only Ms Kirsopp who will be laying the wreath in the church is requi= red at the practice. Ms Kirsopp requested that all Councillors that are available attend the parade.

MIN. 3965. ESSENTIAL CORRESPONDENCE.=

(A). CHESHIRE POLICE AUTHORITY - HAVE YOUR SAY.= Vale Royal Newsletter of October 2008 which inc= ludes a questionnaire asking “Where should the Police focus their time and effort” If any Member wishes to see the News letter or complete the consultation questionnaire please contact the Clerk. Closing date for recei= pt of completed questionnaires is 14th November 2008. The next Meeting of the = Vale Royal Police Forum is on 7th January 2009 at the Community Centre. (B). VALE ROYAL B. C. - DRAFT HISTORIC SUPPLEMENTARY PLA= NNING DOCUMENT CONSULTATION. The Bor= ough Council is in the process of producing a series of

Supplementary Planning Documents (SPD= 217;s) which will form part of the Local Development Framework. A. Draft of the Historic Built Environment is now available for Public Consultation. The document is available on the Council Website. Any Member wishing to comment on t= he Consultation please contact the Clerk. The closing date for comments is 26th November 2008.

MIN. 3965. ESSENTIAL CORRESPONDENCE. (Continued= )

(C). DIRECT CONTACT EXHIBITIONS SEMINAR. Details of a Seminar on Parks and Play which was held on 23rd October 2008. Members were advised of= this Seminar by e. mail.

(D). LOCAL FREELANCE COMMUNITY PROJECT MANAGER.= Prospectus and CV from a Stuart You= nger who is looking for work as a Local Project Worker to deliver a Community ba= sed Project for the Parish.

(= E). GOVERNMENT OFFICE FOR THE NORTH WEST. - THE NORTH WEST OF ENGLAND PLAN - REGIONAL SPATIAL STRATEGY TO 2021. Letter informing the Parish Council that the Regional Spatial Strategy for the Nor= th West of England (The RSS) was published on 30th September 2008. The above documents are available at principle Council Offices, Local Libraries and on the Government for the No= rth West and North West Regional Assembly Website.

(F). VALE ROYAL B. C. - NORTHWICH AREA MEETING.= Notice that the Northwich Area Meeting will be= held on Tuesday 4th November 2008 at 7.00pm in the Memorial Hall, Chester Way, Northwich. Issues for this Me= eting will be Local Government Reorganisation, Connect2 Update. Thundersprint and Question Time. Th= ese are Public Meetings and Members are free to attend. Also provided are copie= s of the Vale Royal B. C. Northwic= h Area Meeting Newsletter of Winter 2008. I will circulate these at the Meeting. There is notice that minor road works will be required during development of Winnington Urban Village. It = was proposed by Ms Kirsopp and seconded by Mr Kennish to enquire what they are,= all in favour.

MIN. 3967. FINANCIAL AND BUDGET STATEMENTS.

PARISH COUNCIL MONTHLY FINANCIAL STATEMENT.

The second half of the precepts have been paid, resulting in £17008.82 being paid out. The Police have not yet been paid £5500 for the PCSO. Accounting for this there will be slightly less than £24000 in= the bank.

PARISH COUNCIL= MONTHLY BUDGET STATEMENT.

The budget has been all paid out with the excep= tion of a few invoices due in the New Year and the PCSO. The Youth Club receive £8000= each year and as yet no accounts have been received, although there is an outstanding vote to receive a copy of their accounts. It was proposed by Mr Turnbull to = write to the top four receivers of precepts and donations and inform them that th= ey need to inform the Council by the next meeting if they would like a new amo= unt next year and request to know how the money was spent last year and the intentions for the money next year. Seconded by Mr Daniels, all in favour. Mr Kennish requested that all outstanding actions from the minutes be put on the agenda for the next meet= ing.

MIN. 3968. RECREATION GROUNDS. <= span style=3D'font-family:Arial'> <= b>

9.1 NURSERY ROAD - PAINTING OF THE SKATE RAMPS<= o:p>

A discussion was held earlier. The Upol paint will be applied in = warmer weather and the rest of the ramp will be painted with cheaper paint.

A suggestion was made to request to use the Com= munity Payback Scheme Graffiti. Ms K= irsopp was wary after the response when used at the cemetery. It was proposed by Mr Kennish to investigate the possibility of using it, seconded by Mr Turnbull, all in favour. A discussion was held= into the possibility of using an alternative paint, as Upol can only be used in = warm weather. Mr Kennish requested= that the Clerk approach the manufacturer to see if there is an alternative for colder months. An alternative= of placing a tent over the ramps and using heaters was considered. The graffiti art is largely untouc= hed so the feeling was not to over paint the bulk of the wall. Mr Wills is to investigate and mon= itor the graffiti.

9.2 NURSERY ROAD - CCTV SOLUTIONS

Vale Royal has no spare capacity so wouldn̵= 7;t give a cost. Alternatives are= to be considered including Chester and Congleton, who are known to have spare capacity. There appears to st= ill be a problem in the early hours. A quote is to be brought to the next meeting.

9.3 TREES AND SHRUBS FOR THE WILD GARDEN=

Number 3 Hayes Dive has requested that the fron= t of the garden be planted with evergreens.&nbs= p; They also requested that the front of the existing garden be replaced with evergreens. No objection= s were noted for planting the gap. T= he back will be planted with evergreens and trees. The grass will be killed and plant= ed directly. Laurel was suggeste= d as it grows quickly. John Hughes will plant in planting season.

9. RECREATION GROUNDS

9.4. NURSERY ROAD - SELF CLOSING GATES

The playground safety inspector has looked at t= he gates and he cannot fix them. There is one that is failing to close. The manufacturer will be contacted.

9.5 NURSERY ROAD - LIGHTS=

The lights were broken and are now operational again. One light is not compl= etely operational but it is still working and will be fixed in spring. An additional circuit breaker was = fitted for the top lights to prevent further trip outs.

9.6 RUNCORN ROAD RECREATION GROUND - IMPROVEMEN= TS TO PLAY EQUIPMENT

There has been no progress on this matter.=

9. 7 RUNCORN ROAD - LITTER COLLECTION

The litter was not collected for three weeks. Vale Royal was contacted and the b= ill was reduced by £60.

MIN. 3969.&nbs= p; POLICE COMMUNITY SUPPORT OFFICER

The monthly report was presented. The next CAM meeting is at the Mem= orial Hall on 12th November. It was reported to the Clerk that PCSO Wiggins was in Northwich town centre on Saturday due to Police being required at a football match. It was suggested that Tim Jackson = is recontacted and invited to attend the next meeting to address issues. It should be asked how many times = the PCSO has worked away from Barnton. The Police should be and are not informing the Council before the PCSO is taken away for work elsewhere. It w= as proposed by Mr Kennish and seconded by Mrs Ashdown that the cheque for the = PCSO is withheld until the council is satisfied that they are performing with th= eir side of the contract. All in favour. It was proposed by Mr Turnbull that alternatively the cheque should be withheld until Tim Jackson attends the meeting. No-one seconded the motion.

MIN. 3970. QUALITY PARISH COUNCIL STATUS -= (COUNCILLOR MR. F. CASEY). There is a Parish Plan but it isn’t finalised. Version 8 is currently being worke= d on but version 9 will be issued. The group is meeting every two weeks with the aim to produce a plan before Chri= stmas.

It was proposed by Mr Kennish and seconded by Mr Turnbull to proceed the meeting past 9.00pm. All in favour.

MIN. 3971.&nbs= p; RISK ASSESSMENT – REPORT OF MEETING HELD ON TUESDAY 2ND SEPTEM= BER 2008. The Risk Assessment = needs to be revisited due to the External Auditors report. Mr Kennish enquired if there was a= best practice template. The Clerk = said that the Auditors believed that the Council was already using one and that there is a computer programme that can be used. The Clerk will contact the Auditor= s for guidance and suggested headings. There is no finish date for the document, it will be asked next year what action was taken.

MIN. 3972.&nbs= p; TOWN AND COUNCIL TREE PLANTING SCHEME. – TO AGREE SITES AND NU= MBER OF TREES REQUIRED. Thirty = four trees are being considered not including the bushes and shrubs for the wild area. Ten trees to be planted= at the junction between Lydyett Lane and Broadway, but permission will be requ= ired from Highways Agency. There i= s to be a line of Cherry trees at the top of Nursery road recreation ground. Twelve trees are to be planted in = the wild area along with shrubs. = Two Oak trees are to be planted, one replacing the Memorial Hall tree but in a different location and one replacing the Cherry tree that didn’t surv= ive. It was suggested that ten trees be planted on the junction of Manor and Church streets but this may depend on = the below ground services. A replacement Birch is required at the Memorial Hall.

MIN. 3973. DATES FOR PARISH COUNCIL MEETINGS IN= 2009 - LIST OF PROVISIONAL DATES

The suggested dates are the corresponding ones = to this year. The only problem m= onth is May due to the two bank holidays. All agreed to the dates which are to be published on the website. The Annual Inspection date will be= decided in spring.

MATTERS ARISING:

Sign  = ; Clerk had contacted Signs of Cheshire re the de= lay of the installation of the sign and had been informed the delay was due to holidays.    =

Unsafe Headstones Estimate received from Ken Macey for headstones to be made good and fitted with ground anchors, where families had died out (10 headstones - £1100.00). Re headstones which were safe but = were leaning - Mr Macey said price would depend on individual headstones. (See further discussion under Finance).

Agreement = The Chairman suggested that a further meeting b= e held after the BJC’s meeting on Monday 10th November.

Internet          = Mr Kennish had raised the issue of the burial records being put onto the Inter= net and had sent the clerk an article regarding the matter. The clerk said this matter had been raised in the past and the members of the Committee had dec= ided against this. The clerk had s= poken to Steve Sharman’s secretary (Witton Cemetery) to ask if their records were available on the Internet.   They too had discussed the matter and had decided against it due to confidentiality etc. The matt= er was discussed and it was decided to put the matter on hold until there was a pu= blic demand for the service.

Clerk’s Nat Insurance       The subject of the employer’s contribution re NI was discussed= and the Chairman confirmed that this should be paid by the BJC.   SK/MG

CORRESPONDENCE

Letter from R Garton re Registration of Parish Council Owned Land re a piece of land which was in dispute. The Chairman explained the situation and confirmed that the matter was in the hands of Barnton Parish Council’s solicitors.&= nbsp;           &nbs= p;          SK/MG

7/2008 &nb= sp;            =           DEEDS AND MEMORIALS

Memorials were approved for Walker (LC469), Tur= ner (LC211A) and Brown(CON441). Inscriptions were approved for Skinner (LC98A) andLoughlin (RC381).             SK/MG

8/2008 &nb= sp;            =           FINANCE=

A Statement of Accounts as at 31st August 2008 = was presented showing a balance of £15435.57 and the members were reminded that the Budget would be set during the next meeting on 10th November. The Chairman said that the accounts looked healthy and sugges= ted that K Macey should be asked to proceed with the work on the headstones (10). The Chairman also said = that subject to a quick review of the accounts at the end of September, K Macey should be asked to carry on with the next 10 headstones. Proposed Mr Kennish, seconded Mrs Gavin. Mrs Walker said that t= here was no rush and went on to say that she&nb= sp; was concerned as a year ago Barnton PC had not paid the Precept when= it was due. The Chairman and Ms Kirsopp both confirmed that Barnton PC would pay the Precept but it would h= ave to be justified. Ms Kirsopp apologised for the Remembrance Garde= n and said that the      = ;    soil in the

garden was so poor and in need of manure/soil conditioner etc. She also said she felt that much hardier plants were needed and that the idea of a scented garden should be abandoned. The subject was discussed and the = clerk was asked to speak to John Hughes to ask if he would do the work involved a= s a one off job. Mrs Walker raised the issue, on behalf of one of the allotment holders, re water on the adjoining allotment and the clerk agreed to speak = to the allotment holder concerned.  = ; VW/MG    =             &nb= sp;
